Welcome to Evolution Supplements. These Terms & Conditions ("Terms") govern your use of our website, purchases, and subscription services provided through Appstle.com. By placing an order or subscribing, you agree to these Terms.

Your Consumer Rights: Nothing in these Terms affects your statutory rights as a consumer under UK law, including the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. These rights are in addition to, and not instead of, the rights given by these Terms.

1. General

  • Evolution Supplements operates an online store selling dietary supplements through our website.
  • By using our site, creating an account, or making a purchase, you confirm that you are at least 18 years old and legally capable of entering into binding contracts under UK law.
  • We reserve the right to update these Terms at any time. Updates will be posted on this page with the revised effective date. Your continued use of our services after changes constitutes acceptance of the updated Terms.
  • These Terms, together with our Privacy Policy and any other documents referenced herein, constitute the entire agreement between you and Evolution Supplements.

2. User Accounts

  • You may need to create an account to access certain features, including subscription management and order tracking.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
  • You must provide accurate, current, and complete information during registration and keep your account information updated.
  • You must notify us immediately of any unauthorized use of your account or any other security breach.
  • We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activity.

3. Orders & Payments

  • All prices are listed in £ (GBP) and include VAT at the applicable rate unless otherwise stated.
  • We accept payment via credit card, debit card, and other payment methods as displayed at checkout.
  • Payment is due at the time of purchase and is processed securely by our third-party payment providers.
  • All orders are subject to acceptance and product availability. We reserve the right to refuse or cancel any order for any reason, including suspected fraud, errors in pricing or product information, or unavailability of products.
  • If we cancel your order after payment has been taken, we will provide a full refund.
  • A contract for the purchase of products comes into existence when we send you an order confirmation email.

4. Pricing & Compare-At Prices

Compare-At Prices and RRP

Our "compare at", "was", or similar reference prices represent the Manufacturer's Recommended Retail Price (RRP) or the typical price at which the product is sold by other retailers in the market. These prices are displayed for comparison purposes only to help you understand the value of our offering.

Please note:

  • We may not have previously sold the product at the compare-at price shown on our website.
  • RRP prices are set by manufacturers and reflect their recommended selling price.
  • Compare-at prices represent genuine market prices where the product is or has been available from other retailers.
  • All prices are shown in GBP (£) and include VAT unless otherwise stated.

Current Prices

All prices displayed on our website are current at the time of browsing. We reserve the right to change prices at any time without prior notice. The price applicable to your order will be the price displayed at the time you complete your purchase and receive order confirmation.

Price Accuracy

While we make every effort to ensure pricing accuracy, errors may occasionally occur. If we discover a pricing error on a product you have ordered, we will contact you as soon as possible to inform you of the error and give you the option to:

  • Proceed with the order at the correct price, or
  • Cancel the order for a full refund.

We are not obligated to fulfill orders where a clear and obvious pricing error has occurred.

Savings Claims

Any savings or discount percentages shown are calculated based on the difference between our current selling price and the compare-at price (RRP). Actual savings may vary depending on where and when products are purchased elsewhere.

5. Product Availability

  • All products are subject to availability. We make every effort to keep stock information accurate, but products may occasionally be out of stock.
  • If a product becomes unavailable after you place an order, we will contact you to offer a suitable alternative or a full refund.
  • We reserve the right to discontinue products at any time without prior notice.
  • For subscription orders, if a subscribed product is discontinued, we will contact you to arrange a suitable replacement or cancel the subscription with no penalty.

6. Subscriptions ("Subscribe & Save")

Our subscription service is powered by Appstle.com. By subscribing, you agree to the following:

Subscription Commitments

  • Customers who sign up to a product subscription must complete a minimum of two (2) successful orders before being eligible to cancel.
  • After these two successful orders, you may request cancellation of your subscription at any time by contacting us in writing via email or through your account portal.

Discounts & Benefits

  • Active and new subscribers currently receive a 5% discount on their subscription products.
  • This discount rate and product price are subject to change at any time. Any changes will be communicated to you in writing at least 14 days before taking effect.
  • If you do not wish to continue your subscription following a price increase, you may cancel without penalty.

Cancellation by the Customer

  • If you choose to cancel a subscription after meeting the minimum order requirement, the cancellation will apply from the next scheduled order.
  • If you cancel a subscription, you may re-subscribe to the same product after a cooling-off period of 3 months from the date of cancellation.

Important: In rare circumstances, if we authorise a cancellation before two successful deliveries, a cooling-off period of 3 months will apply before you can re-subscribe to that product.

Cancellation by Evolution Supplements

  • We reserve the right to cancel any subscription at our sole discretion, including for reasons such as product discontinuation, suspected fraud, or breach of these Terms.
  • If we cancel your subscription, you will be notified in writing and will not be charged for any future deliveries.

General Subscription Terms

  • Subscriptions are personal and non-transferable.
  • Subscriptions renew automatically based on the frequency you select at the time of subscription.
  • You may update delivery frequency, product selections, delivery address, or payment details through your account portal at any time.
  • If a payment cannot be processed, we will attempt to contact you. If we cannot process payment after reasonable attempts, we may pause or cancel your subscription until valid payment details are provided.
  • For subscriptions that offer multiple flavour options, you may change your selected flavour after completing two successful deliveries—as often as you like (even every month). Once your second delivery has been processed, you'll gain access to amend your flavour preferences directly through your customer portal.
  • If you wish to change your flavour for the second delivery, please contact us at least 7 days prior to your scheduled dispatch date so we can update your order accordingly.

7. Shipping & Delivery

  • Orders are shipped to the delivery address provided at checkout. Please ensure this address is accurate and complete.
  • Delivery times provided are estimates and may vary depending on your location, the delivery service used, and circumstances beyond our reasonable control.
  • We will make reasonable efforts to deliver products within the estimated timeframe, but delivery times are not guaranteed.
  • Risk of loss and title for products purchased pass to you upon delivery to the carrier.
  • We are not liable for delays caused by events outside our reasonable control, including but not limited to extreme weather, natural disasters, strikes, or carrier delays.
  • If you are not available to accept delivery, the carrier may leave a notice with instructions for collection or re-delivery.
  • Delivery charges, if applicable, will be clearly displayed at checkout before you complete your purchase.

8. Returns, Refunds & Cancellations

Your Right to Cancel (Distance Selling)

Under the Consumer Contracts Regulations 2013, you have the right to cancel your order within 14 days of receiving the products, without giving any reason.

To exercise your right to cancel, you must inform us of your decision by contacting us at sales@evolutionsupplements.co.uk before the 14-day period expires.

Exceptions to the Right to Cancel

  • Products that have been unsealed after delivery and are unsuitable for return due to health protection or hygiene reasons (this applies to most supplement products once opened).
  • Subscription orders are subject to the two-delivery minimum commitment and cannot be cancelled or refunded before the second delivery is completed, except where products are faulty or mis-described.

Returns Process

  • Products must be returned in their original, unopened, and unused condition with all original packaging and labels intact.
  • You are responsible for the cost of returning products unless the product is faulty or we delivered the wrong item.
  • Once we receive and inspect the returned products, we will process your refund within 14 days to the original payment method.

Faulty or Incorrect Products

  • If you receive a faulty or incorrect product, please contact us immediately at sales@evolutionsupplements.co.uk with details and photographic evidence if possible.
  • We will arrange for collection or replacement at no cost to you and will issue a full refund or replacement as appropriate.

Non-Returnable Items

For health and safety reasons, we cannot accept returns of supplements that have been opened or used, except where the product is faulty.

9. Product Information & Health Disclaimer

  • All products are intended for use as dietary supplements only and are not intended to diagnose, treat, cure, or prevent any disease.
  • Product information, including descriptions, ingredients, nutritional information, and usage instructions, is provided by manufacturers and is believed to be accurate. However, we do not warrant that such information is complete or error-free.
  • Information provided on our website is for general informational purposes only and should not be considered medical or professional advice.
  • You should always read product labels, warnings, and directions before use.
  • Consult a qualified healthcare professional before using any supplement, especially if you are pregnant, nursing, taking medication, or have a medical condition.
  • Individual results may vary. Testimonials and results mentioned are not typical and your results may differ.
  • Keep all supplements out of reach of children.
  • We make no representations or warranties regarding the suitability of products for any particular purpose.

  • All content on this website, including but not limited to text, graphics, logos, images, videos, product descriptions, and software, is the property of Evolution Supplements or our licensors and is protected by UK and international copyright, trademark, and other intellectual property laws.
  • You may not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any material from our website without our prior written consent.
  • The Evolution Supplements name and logo are trademarks of Evolution Supplements. You may not use these trademarks without our prior written permission.
  • Limited permission is granted to download, print, or view content solely for your personal, non-commercial use, provided you keep all copyright and proprietary notices intact.

11. Privacy & Data Protection

  • Your use of our website and services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.

13. Limitation of Liability

What We Are Not Liable For

To the maximum extent permitted by law, Evolution Supplements shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses.
  • Damages resulting from your use or inability to use our products or services.
  • Damages resulting from any products purchased or obtained through our website.
  • Unauthorized access to or alteration of your data or communications.
  • Acts or omissions of third parties, including payment processors, delivery services, or manufacturers.

Limitation Amount

Our total liability for any claim arising from your use of our products or services shall not exceed the amount paid by you for the specific product or subscription in question.

Important Legal Notice

Nothing in these Terms excludes or limits our liability for:

  • Death or personal injury arising directly from our proven negligence in the supply, storage, or handling of products where we have breached our duty of care
  • Fraud or fraudulent misrepresentation by Evolution Supplements
  • Breach of the terms implied by Section 12 of the Sale of Goods Act 1979 (our right to sell the products and your right to possess them)
  • Breach of the terms implied by Sections 13, 14, or 15 of the Sale of Goods Act 1979 (products matching their description, being of satisfactory quality, and being fit for their intended purpose)
  • Defective products under the Consumer Protection Act 1987 where the defect existed at the time of supply and causes damage
  • Any other liability that cannot lawfully be excluded or limited under UK consumer protection legislation

Important Clarification: This clause relates solely to our direct legal liability as a supplier. It does not constitute an admission of fault, nor does it create liability where none would otherwise exist under law. We are not liable for outcomes resulting from misuse of products, failure to follow instructions, pre-existing medical conditions, allergic reactions to disclosed ingredients, or circumstances beyond our reasonable control.

14. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from events beyond our reasonable control, including but not limited to:

  • Acts of God, natural disasters, extreme weather conditions, floods, fires, or earthquakes.
  • War, terrorism, civil unrest, riot, or invasion.
  • Government actions, laws, regulations, or embargoes.
  • Strikes, lock-outs, or other industrial disputes.
  • Pandemic, epidemic, or public health emergency.
  • Failure of public or private telecommunications networks, power failures, or internet service disruptions.
  • Failure of suppliers, manufacturers, or delivery services.

If a force majeure event continues for more than 30 days, either party may terminate the affected order or subscription with written notice.

15. Dispute Resolution

  • If you have any concerns or disputes regarding our products or services, please contact us first at sales@evolutionsupplements.co.uk. We will make every effort to resolve issues informally and amicably.
  • If we cannot resolve a dispute informally, you may refer your complaint to the relevant Alternative Dispute Resolution (ADR) body or the Online Dispute Resolution (ODR) platform provided by the European Commission (if applicable).
  • You may also have the right to bring proceedings in the courts of England and Wales or, if you are a consumer resident in Scotland or Northern Ireland, in the courts of your home jurisdiction.

16. Governing Law & Jurisdiction

  • These Terms and any disputes arising from or in connection with them shall be governed by and construed in accordance with the laws of England and Wales.
  • If you are a consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident.
  • Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, although if you are a consumer resident in Scotland or Northern Ireland, you may bring proceedings in your local courts.

17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid, illegal, or unenforceable provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable.

18. Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. No waiver by us of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition.

19. Assignment

You may not assign, transfer, or delegate any of your rights or obligations under these Terms without our prior written consent. We may assign, transfer, or delegate our rights and obligations under these Terms without your consent, provided that such assignment does not adversely affect your rights under these Terms.

20. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or policies published on our website, constitute the entire agreement between you and Evolution Supplements regarding your use of our website and services, and supersede all prior agreements, understandings, and representations.
